Why Compliance Matters
Legal Requirements
Every commercial property must have a valid EPC when it’s built, sold or let — this has been a legal requirement since 2008. But for rented property, the real exposure isn’t just having a certificate; it’s its rating.
Under the Minimum Energy Efficiency Standards (MEES), non-domestic property must currently achieve at least an E rating to be legally let, unless a valid exemption is registered. Letting a property below that threshold carries serious financial risk: fines of up to £50,000 for breaches under three months, rising to up to £150,000 for breaches of three months or more (calculated against the property’s rateable value) — and the breach is published publicly.
The standard is also getting stricter. Government proposals (confirmed June 2026) would require buildings over 1,000 sqm to reach a B rating by 2031, where cost-effective. Buildings under that size stay at E for now, with more flexibility to improve over time. Getting an accurate, up-to-date assessment now means you know exactly where a property stands — and what, if anything, needs addressing before a sale, letting, or compliance deadline catches you out.

A couple of practical notes: keep an eye on that 2031/B-rating change since it’s not law yet — it still needs secondary legislation to pass through Parliament, so I’d phrase it as “proposed” rather than definite, which I’ve done above. Once it’s confirmed in legislation, that paragraph is worth tightening to sound more certain, since it’ll become a stronger urgency hook, especially for larger commercial clients.
